The information recorded and the purpose of the processing

BIRCH Law Firm collects and processes personal data in connection with the performance of legal assistance and advice, case handling, conducting legal proceedings, mediation, administration of funds, teaching and marketing.

We collect and process personal data relating to the parties to the case, which may include both individuals and companies, organisations and individuals associated with the parties to the case, and the information used for com-
munication and for the handling of specific cases and in connection with legal advice.

The information recorded may include your name, address, telephone number, email address and workplace. Where relevant for the purpose of registration on government portals, e.g. the case portal minretssag.dk or virk.dk, are registered and CPR-numbers are also processed. In addition, we will, where necessary and appropriate in connection with the resolution of a specific case, record and process health information, information about social circumstances, including information on employment and income, insurance cover and other relationships with third parties.

Collection and storage of personal data is always carried out for specific and legitimate purposes. BIRCH Law Firm ensures at all times that there is no more information collected than is necessary for the resolution of a particular case or issue.

Dislosure

Personal data will only be disclosed when it is relevant and necessary in connection with the handling of a particular case or legal matter issue. Recipients of personal data may be opposing parties, the opposing parties´ lawyers, experts, e.g. medical consultants, public authorities and organisations as well as the courts.

Data security

BIRCH Law Firm uses IT solutions that ensure that personal data is only accessible to the relevant individuals. All employees at BIRCH Law Firm are bound by a duty of confidentiality and policies and procedures that ensure, at all times, that personal data is processed and stored securely.

Storage

Personal data is retained for the duration of a given case during the proceedings and for a period following the conclusions of the case generally, for five years. If special circumstances apply applicable e.g. longer limitation periods in cases in relation to personal injury, cases including personal data is retained for up to 30 years thereafter.

The rights of data subjects

Individuals, in respect of whom BIRCH Law Firm has registered data, always have the right to access the recorded information and to obtain a copy of the recorded information corrected or deleted.

Data subjects also have the right to require restrictions on the processing of personal data, as well as to object to the processing of personal data.

Furthermore, data subjects always have the right to receive personal data in a structured and machine-readable format (data portability).

If the processing of personal data is based on consent given for the collection and recording of personal data, it may register to be able to withdraw their consent at any time withdrawal. Any withdrawal of consent does not affect the lawfulness of the processing of the personal data, before consent is withdrawn back.
